Terms and Conditions

Porsche Cars Great Britain Limited (trading as Porsche Experience Centre) a company incorporated in England and Wales with company number 00861097 whose registered office address is at Bath Road, Calcot, Reading, Berkshire, RG31 7SE (“Porsche” or “we”) agrees to provide the Driving Experience (as defined below) subject to the following terms and conditions.

1. THESE TERMS

1.1. What these terms cover.
These are the terms and conditions on which you make a booking for a Driving Experience and on which Porsche supplies the Driving Experience to the Participant(s).

1.2. Why you should read them.
Please read these terms carefully before you submit your booking to Porsche or confirming the date of your Driving Experience. These terms tell you who we are, how we will provide the Driving Experience to you, how you and Porsche may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss further.

2. Definitions

"Agreement" means these terms and conditions, the Email Confirmation and Conditions of Participation Form, as may be amended as agreed by the Parties in writing from time to time;

"Conditions of Participation Form" means the conditions of participation form to be completed by the Participant prior to participating in the Driving Experience, the current version of which is available to view here: https://www.porsche.com/silverstone/en/conditions-participation/;

"Customer" or "you" or "yourself" means the individual booking the Driving Experience, which individual Porsche has invited to take part in the Driving Experience as the individual has purchased a Qualifying Vehicle;

“Driving Experience” means the half-day Porsche driving experience course and/or a Porsche track experience course provided by Porsche at the Porsche Experience Centre;

“Email Confirmation” means the booking confirmation email sent to the Customer following a booking;

“Fees” means the total amount payable by the Customer in consideration of the provision of the Driving Experience, which Fees are included within the price for the Qualifying Vehicle purchased by the Customer;

“GBP” the lawful currency of the United Kingdom;

“Participant(s)” means the participant(s) taking part in the Driving Experience;

“Porsche Experience Centre” means Porsche Experience Centre, Hangar Straight, Silverstone Circuit, Towcester, NN12 8GR or such other location as we may notify you at the time of booking; and

“Qualifying Vehicle” means a Porsche Approved Taycan purchased with Solutions Personal Contract Plan or Hire Purchase between 12.07.2024 and 30.09.2024.

3. Bookings and your contract with Porsche

3.1. Bookings.
Porsche will invite you to participate in a Driving Experience. Once you have received the invitation, you may book a Driving Experience by: (i) booking online at https://experienceshop.porsche.com, (ii) calling us on +44 (0)1327 855 911 or (iii) emailing us at drivingexperience@porsche.co.uk.

3.2. How we will accept your booking.
Our acceptance of your booking will take place when we send you the Email Confirmation confirming the applicable Driving Experience booked and price paid, at which point a contract will come into existence between you and Porsche. The making of a booking constitutes your acceptance of the terms and conditions set out in this Agreement.

3.3. Availability.
The booking of the Driving Experience is subject to availability. The confirmation of the date and the Driving Experience will constitute by acceptance by the Participant of the terms and conditions set out in this Agreement.

3.4. Website.
The content of the Website is directed solely at those who access the site from the United Kingdom.

3.5. Change to date or Driving Experience.
If you wish to make a change to the Driving Experience you have booked or the date of the Driving Experience please contact us. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the Driving Experience or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.

4. Fees and Payment

4.1. When you must pay and how you must pay.
The Fees must be paid in full in GBP at the time of booking the Driving Experience.

4.2. Payment of Any Additional Amounts.
Additional amounts payable by the Customer to Porsche under this Agreement due to agreed amendments to the booking (such as a change to a more expensive Driving Experience under clause 3.5, or if you wish to book a different model) shall be paid by credit card or debit card within 14 days of receipt of an invoice from Porsche. We will always seek your consent prior to charging you for any additional amounts. All payments due under this Agreement shall be made in full without any deduction whether by way of set-off, counterclaim, discount, abatement or otherwise.

4.3. We can charge interest if you pay late.
If the Customer fails to make any payments due under this Agreement by their due date, the Customer shall pay interest on the overdue amount at the rate of 2% per annum over the base rate from time to time of the Bank of England.] Such interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount.

4.4. Change of VAT rates.
If the rate of VAT changes between your booking date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.

4.5. Payment in foreign currency.
All prices shown on our websites are in GBP and all transactions are conducted in GBP. If ordering from overseas or in a foreign currency account you may be charged fees by your bank to process the transaction. These fees are in addition to any prices on our website and are beyond our control.

5. Bookings

5.1. Expiry of Bookings.
Where, at the time of booking, you are not able to confirm the date for the Driving Experience, you should contact Porsche to agree the date of the Driving Experience as soon as you are able. Customers must take part in the Driving Experience before 22 December 2024.

After the expiry date set out above, such booking shall expire and you shall not be entitled to a refund if you do not attend a Driving Experience in respect of such booking.

5.2. Fraud etc.
We will not be responsible for any loss you may incur as a result of theft, impersonation or identity fraud.

5.3. Driving Experience may vary from their pictures.
The images of the available Driving Experiences on our website or in our brochures are for illustrative purposes only. Although we have made every effort to display the concept of the Driving Experiences accurately, we cannot guarantee that the images and description accurately reflects the actual Driving Experience which may vary from those images and descriptions, including but not limited to the colour and models featured.

6. The Driving Experience

6.1. Provision of the Driving Experience.
Subject to the payment of the Fees, Porsche shall provide the Driving Experience to the Participant(s) in accordance with the terms of this Agreement and we are under a legal duty to supply the Driving Experience in conformity with this Agreement.

6.2. Where the Driving Experience takes place.
All Driving Experiences will take place at the Porsche Experience Centre.

6.3. Circumstances outside of Porsche’s reasonable control.
We reserve the right to:

6.3.1. alter; or

6.3.2. postpone or cancel,
a Driving Experience in each case if we are unable to perform our obligations under this Agreement due to circumstances beyond Porsche’s reasonable control, including but not limited to:

(a) adverse weather conditions which may affect the safety of Participants and incidents affecting transport and public safety;

(b) unforeseen equipment malfunction and/or unplanned necessary maintenance;

(c) war, an act of terrorism, strikes, industrial action short of a strike, import or export embargo, lockout, accident, fire, blockade, flood, natural catastrophe, protests, pandemic or epidemic; or

(d) the application of any statute, regulations, guidance and/or advice in respect of coronavirus (COVID-19) or other pandemic or epidemic, or we, in our sole discretion, deem it prudent to alter, postpone or cancel a Driving Experience in order to combat the spread of coronavirus (COVID-19) or other pandemic or epidemic.

Decisions regarding such circumstances can often only be made on the day of the Driving Experience and possibly after your Driving Experience has already commenced. Notice will be given as soon as reasonably practicable.

6.4. Re-booking in the event of postponement or cancellation under clause 6.3.2.
Where Porsche postpones or cancels a Driving Experience in accordance with clause 6.3.2 above, the Customer may:

6.4.1. cancel the contract in accordance with clause 7.1.4; or

6.4.2. within 60 days of the original date of the Driving Experience, re-schedule their Driving Experience subject to availability by contacting Porsche.

If the Customer has not re-booked the Driving Experience within 60 days of the date of the original Driving Experience, Porsche may treat the contract as cancelled by the Customer.

7. Your rights to end the contract

7.1. Ending the contract because of something we have done or are going to do.
If you are ending a contract for a reason set out at 7.1.1 to 7.1.4 below the contract will end immediately. The reasons are:

7.1.1. we have told you about an upcoming material change (not otherwise referred to in this Agreement) to the Driving Experience or to the Agreement that you do not agree to;

7.1.2. we have told you about an error in the price or description of the Driving Experience you have ordered and you do not wish to proceed;

7.1.3. you have a legal right to end the contract because of something we have done wrong; or

7.1.4. there is a risk that the Driving Experience cannot take place on the confirmed date because of circumstances outside of Porsche’s reasonable control in accordance with clause 6.4.1.

7.2. Right to change your mind.
The Customer may cancel the Driving Experience at any time before the later of: (i) 31 days before the date of the Driving Experience and (ii) 14 days after the date on which the Email Confirmation is sent to you.

7.3. How to end the contract with us.
To end the contract with us, you can complete and return the cancellation form set out in the Appendix to this Agreement. You can also cancel by calling customer services on +44 (0)1327 855 911 or emailing us at drivingexperience@porsche.co.uk. Please provide your name, home address, details of the order and, where available, your phone number and email address.

7.4. Refunds.

No refunds are payable to the Customer in any circumstances.

7.5. Qualifying Vehicle purchase cancellation.
Each Customer who has been invited to a Driving Experience due to the Customer purchasing at a Porsche Centre a Qualifying Vehicle has been invited by Porsche on the basis that the Customer proceeds with such purchase to fulfilment, by paying in full and taking delivery of such vehicle from the Porsche Centre. If a Customer cancels such purchase or rejects such Qualified Vehicle after booking such Driving Experience, we may cancel the Driving Experience and no refund shall be payable to the Customer, and we will not be liable for any costs or losses incurred by the Customer in these circumstances (including but not limited to costs arising from travel and accommodation bookings).

8. Our rights to end the contract

8.1. Ending the contract for non-payment.
We may end the contract for a Driving Experience at any time by emailing you if you do not make any payment to us when it is due and you still do not make payment within 10 days of us reminding you that payment is due.

8.2. Compliance with instructions.
Porsche may immediately terminate this Agreement without notice in the event that any Customer or Participant or the Customer’s or Participant’s guests to the Porsche Experience Centre refuses to comply with the reasonable instructions of Porsche’s staff, vandalises or deliberately damages the Porsche Experience Centre or any property located at the Porsche Experience Centre, or behaves in an inappropriate or unacceptable manner. In such cases there shall be no reimbursement of the Fees or any other compensation due to the Customer.

8.3. We may withdraw the Driving Experience.
We may write to you to let you know that we are going to stop providing all or some of the Driving Experiences. We will let you know at least 60 days in advance of our stopping the supply of any Driving Experience you have booked.

9. Participants and attendance at the Porsche Experience Centre

9.1. Requirements of Participants. Participants must:

9.1.1. be over 21 years of age;

9.1.2. hold a full UK Driving Licence to drive a vehicle upon public highways or hold a valid full foreign Driving Licence and be entitled to drive a vehicle upon public highways in the UK under such licence;

9.1.3. produce their original photo-card driving licence when signing the Conditions of Participation Form (or, if they do not hold a photo-card driving licence, their counterpart driving licence together with their passport);

9.1.4. produce a copy of the Email Confirmation;

9.1.5. be medically fit to participate and have eyesight up to the standard required of a road driving test;

9.1.6. not be suffering from any disability which is likely adversely to affect the ability of the Participant to control a vehicle;

9.1.7. not attend the Porsche Experience Centre under the influence of alcohol or having taken any form of medication, drugs or other substance;

9.1.8. not know of any reason or factor, which will or may impair their driving abilities or restrict them from participating in the Porsche Driving Experience;

9.1.9. not participate in any driving activities unless they have first received a drivers briefing, following which the Participant will abstain from participating should they not agree or understand the inherent risks involved;

9.1.10. at all times follow the instructions given by Porsche, its employees, agents and/or contractors whilst at the Porsche Experience Centre;

9.1.11. wear a seat belt at all times; and

9.1.12. complete and sign the Conditions of Participation Form before participating in the Driving Experience.

9.2. Availability of Vehicles.
Porsche is not under any obligation to ensure that any specific model of vehicle is available on the date of your Driving Experience. The vehicles available at the Porsche Experience Centre are subject to constant change due to (amongst other things) models being updated, for technical and mechanical reasons and due to the popularity of specific models being used by other participants. Therefore the use of any specific model of vehicle remains at all times subject to the availability of the specified vehicle on the date of your Driving Experience.

9.3. Licence Check.
You consent to Porsche undertaking a licence check with the DVLA and to Porsche being satisfied (at its sole discretion) with the result prior to any Participant commencing any Driving Experience.

9.4. Insurance organised by Porsche.
Where Porsche organises insurance of any vehicles, the Participant accepts that it will owe Porsche and its insurer a duty of utmost good faith which includes an obligation to let Porsche, its employees, agents and/or contractors know of anything that will or may affect the validity or continuity of Porsche's insurance policy. The Participant must have disclosed any such matter or fact already known to the Participant (and will disclose any such matter or fact that becomes known to the Participant). The Participant may not be covered by Porsche's insurance if they have not disclosed such matter or fact, or if any statements or promises the Participant makes are untrue or incomplete.

9.5. Guests.
You shall be permitted to bring one spectating guest to the Porsche Experience Centre free of charge (excluding the cost of food and drink). A fee will be charged for any additional guests, pricing for which is available from Porsche on request. Guests are not permitted to join the Participant inside of the car during the Driving Experience. The Participant will be responsible for their guests at all times. Children under 16 must be supervised at all times while at the Porsche Experience Centre. Porsche reserves the right to require any guest(s) of any Participant who does not comply with any requirements set out in this Agreement or the reasonable instructions of Porsche to leave the Porsche Experience Centre. If food and drink is required for any of the guests, pricing for this is available from Porsche on request.

9.6. Exclusion of Participants.
Porsche reserves the right to exclude any Participant who does not comply with any requirements set out in this Agreement or who is suspected of being under the influence of alcohol and/or drugs. In such cases there shall be no reimbursement of the Driving Experience Fee.

9.7. Prohibited items.
The following items must not be brought onto the Porsche Experience Centre by the Participant or any guest of any Participant without the prior written consent of Porsche:

9.7.1. foreign objects such as, but not limited to, confetti, balloons, signage/fixings, candles or indoor fireworks;

9.7.2. food or beverages;

9.7.3. flammable, combustible or objectionable substance or liquid; or

9.7.4. any other substance or item which is likely, in Porsche’s reasonable opinion, to present a health and safety hazard or other risk to persons, property or vehicles at the Porsche Experience Centre.

9.8. Personal possessions.
The Participant is responsible at all times for the safety and security of any items belonging to them or their guests, and brought to the Porsche Experience Centre by them. Porsche will not in any circumstances be liable to the Customer for any loss or damage to any such item howsoever arising.

9.9. Removal of items.
Porsche has the right to remove and dispose of any goods or articles left on the Porsche Experience Centre after the Driving Experience have been performed without any liability whatsoever. Any costs of disposal will be recharged to the Customer.

9.10. Maximum numbers.
Porsche reserves the right to refuse entry to the Porsche Experience Centre of any individuals where this exceeds the numbers agreed between the Customer and Porsche. In the event that Porsche permits numbers above those agreed at the time of booking then the Customer acknowledges that Porsche has the right to charge the Customer a fee for those additional numbers.

9.11. Allergies and dietary requirements.
Please give as us as much notice as possible of any allergies and dietary requirements using the contact details in clause 12.1. This data will be processed in accordance with clause 10.1.

10. Data Protection

10.1. How we will process your personal data.
We will only use your personal data as set out in the Porsche Experience Centre Privacy Notice that is available at https://www.porsche.com/silverstone/en/privacy-notice/.

11. Liability

11.1. Liability for death or person injury.
Nothing herein shall be deemed to exclude liability for death or personal injury on the part of either you or Porsche.

11.2. Porsche’s liability to you.
You understand that Porsche will be responsible for (i) any personal injury you suffer as a result of Porsche’s own negligence or the negligence of its employees, agents or contractors and also for (ii) any loss or damage (not including any purely financial or business loss, such as loss of revenue, loss of profit or loss of opportunity) you suffer that is caused by Porsche’s breach of contract, or breach of legal duty of care, where such loss or damage is reasonably foreseeable. Loss or damage is “reasonably foreseeable” if, at the time you and Porsche entered into this Agreement, such loss or damage was contemplated by you and Porsche. You accept that Porsche will not be responsible for any other loss or damage arising from your participation in the Porsche Driving Experience, whether as a passenger or as a driver.

11.3. Your liability to Porsche.
You accept that if, in connection with your participation in the Porsche Driving Experience, any loss or damage is suffered by Porsche, its employees, agents and/or contractors, or by any third party, as a result of your negligence or any breach of any of the above terms, then you shall be responsible for (i) all losses, damages or expenses suffered by Porsche, its employees, agents and/or contractors and (ii) if Porsche organises insurance of the vehicles, any excess on any insurance policy maintained by Porsche in respect of the vehicle liability, up to a maximum of five hundred pounds (GBP £500) if you are aged 21 years or older and have held your driving licence for more than two years or one thousand pounds (GBP £1,000) if you are aged under 21 years and/or have held by driving licence for less than two years.

11.4. Porsche is not liable for business losses.
Porsche only supplies the Driving Experience under this Agreement for private use by you as a consumer. If the Driving Experience is used for any commercial, business or re-sale purpose Porsche will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

11.5. Porsche does not in any way exclude or limit its liability for any liability that cannot be excluded by law.

11.6 In the circumstances set out in:

11.6.1 clause 6.3 (Circumstances outside of Porsche’s reasonable control);

11.6.2 clause 7.2 (Right to change your mind);

11.6.3 clause 8.1 (Ending the contract for non-payment); and

11.6.4 clause 8.2 (Compliance with instructions), Porsche will not be liable for any costs or losses incurred by you (including but not limited to costs and losses arising from travel and accommodation bookings) arising from such circumstances.

11.7 In the circumstances set out in:

11.7.1 clause 7.1.1 (material change that you do not agree to);

11.7.2 clause 7.1.2 (error in the price or description of the Driving Experience);

11.7.3 clause 7.1.3 (your legal right to end the contract because of something we have done wrong); and

11.7.4 clause 8.3 (We may withdraw the Driving Experience),
you agree to minimise any costs or losses that you may incur arising from the ending of the contract.

12. General Provisions

12.2. How we may contact you.
If we have to contact you we will do so by text message, telephone or by writing to you at the email address or postal address you provided to us in your order.

12.3. Waiver.
No failure or delay on the part of any party to exercise any right or remedy under this Agreement will operate as a waiver thereof and no waiver by any party in respect of any breach shall operate as a waiver of any subsequent breach.

12.4. Transfers.
You may not transfer your rights or your obligations under these terms to another person.

12.5. Third Party Rights.
Nothing in this Agreement whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise shall confer on any third party any benefit or the right to enforce any term contained herein.

12.6. Severability
If at any time, any one or more of these obligations is or becomes invalid, illegal or unenforceable in whole or in part but would be valid if some part thereof were deleted or the period or application reduced such obligation shall apply with such modification as is necessary to make it valid and effective and in any event the validity, legality and enforceability of the remaining clauses and sub-clauses shall not in any way be affected or impaired thereby.

12.7. Publicity.
The Customer shall seek and obtain the prior written approval of Porsche in respect of any press release or announcement which makes reference to Porsche or the Porsche Experience Centre; the use, publication or release of any photograph, drawing or other image or product depicting the Porsche Experience Centre; and the use, publication or release of any material which incorporates any trade mark of Porsche or its associated companies.

12.8. Intellectual property.
All product and company names and logos referred to on the website are the trade marks, service marks or trading names of their respective owners including Porsche. The Customer may download material from the website for the sole purpose of placing an order with Porsche or to use the website as a shopping resource. The Customer may not modify, copy, reproduce, republish, upload, post, transmit or distribute by any means or in any manner any material or information on or downloaded from the Porsche website without prior written consent from Porsche.

12.9. Linked sites.
Porsche do not make any representations whatsoever about any other websites which the Customer may access through the Porsche website or which may link to the Porsche website. Porsche have no control over the content of availability of any websites linked to their website. In addition, a link to any other website does not mean that Porsche endorse or accept any responsibility for the content or use of any such linked website and Porsche shall not be liable for any loss or damage caused by or in connection with use of or reliance on any content, goods or services available on or through any other website or resource.

12.10. Computer system.
The Customer is responsible for ensuring that their computer system meets all relevant technical specifications necessary to use the Porsche website and is compatible with the Porsche website. Porsche cannot guarantee or warrant that any material available for downloading from their website will be free from infection, viruses and/or other code that has contaminating or destructive properties. The Customer is responsible for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy their requirements for the accuracy of the data input and output. Porsche accepts no liability for loss or damage suffered by the Customer arising out of or in connection with the viewing, use or performance of our website or its contents except where Porsche have been negligent.

12.11. Complaints.
Any complaints in relation to a Driving Experience should be made in writing and sent to Porsche Cars Great Britain Limited, Porsche Experience Centre, Hangar Straight, Silverstone Circuit, Towcester, NN12 8GR or emailed to drivingexperience@porsche.co.uk.

12.12. Governing Law.
This Agreement and any non-contractual obligations arising out of this Agreement shall be governed and construed in accordance with the Laws of England and Wales and the parties hereby submit to the exclusive jurisdiction of the English courts.
